Hi Lynn, I was awarded ESA after 6 months of full pay on the sick, when my pay got cut to half they awarded me it. After 6 more months I had to go for a medical, and was awarded 12 points, thats how they work it out, your illness is assed in points ( bloody ridiculas if you ask me) anyway that was not enough and I had to apeal. I went to see a guy from welfare rights, who filled in the form for me and also represented me at the tribunal, which I won it took all of 5mins.... The judge awarded me an extra 12 points which took it over the 15 that you need. I realy think its an unfair system, It only changed to ESA 3 months before I came off work. So my ESA went from 60 odd pound a week £92 a week, I have also been awarded DLA indefinetly. I have just been retired early on health grounds from work and still get my ESA. Dont give up go for it its only what you deserve. sos for such a long post hope it helped. T.C.

Lynn r, morning, just put your claim in and if you are refused appeal. If you don't ask you won't get. It seems everyone has to appeal so you are not alone on that one!! Its a bit of a trial when you already are unwell but stick with it, its your right. Take Care

You may not be eligible for Contributary ESA but you are entitled to Income based ESA which is exactly the same amount of money, I am surprised they did not tell you this, the only reason I can think of is that if you have a partner that works...
have a look at www.consumeractiongroup.co.uk and go to the Forum named Benefits, tax credits and minimum wage, if you can't find a thread that is relevant to you start one there are loads on there that will be bale to give you solid advice.
Good luck xx

You should be claiming Council Tax Credit Housing Benefit. Have you tried Family Tax Credit. Lynnr, hang in there until you have tried these options. Wish you luck. Take Care

laughed as it says Living Expenses...what world are they living in when £67.50 a week coveres living expenses

Im not entitled to anything else and still arguing DLA.

Being realistic I have to force myself to go back to work next week for full pay even though I am not well.

The GP supports it but then again people know what I think of my specialists and GP's so no need to say owt lol
