Subject: turned down for dla.

has the title says i've been turned down for dla, i swear they don't read the forms for get the new change in circumstances.

my form which they sent to me said i don't get dla cause i can walk without aid for 150 meters which applied in October but in Nov my knees started to deteriorate and i had too use crutches in and out side to get about which i informed them about and also i need help getting into the bath, cooking e.g pots and pans, and other personal help.

awwww so angry, asked the to look at my claim again and going to citizens advice next week for help. i am also waiting to see occupational therapy and social services for help.

sorry to rant just so angry, my work are trying to make me redundant through occupational health so they don't have to keep my job open while i'm on esa benefit.

thanks for reading anyone with any advice would be great.xxx

don't give up go and get help from the citizens advice i was turned down and the CAB sent an appeal that was turned down so went to tribunal and i won it took 10 months all together , but i am glad i didn't give up now the CAB said it is very unlikley you get it first time good luck

Davina please dont give up... go to citizens advise and get them to help you with an appeal form, its your right, dont get angry just keep on at them, fingers crossed. x

if u want dla you need to embellish the truth a little, think about what its like for you on your worst of days, use that as a reference point. dont tell them how far your able to walk on a good day, as they dont want to pay out unless they think its absolutely necessary!! you have to live with this chronic disease and deserve the help that is set aside by the government. my grandad went through the same thing they turned him down twice untill they eventually awarded it after a persistant battle!! and now im in the same boat awaiting a response myself. talk to your rheumy,gp get them on your side. get all the help you possibly can, u deserve it!!

daniel is right you must go by your bad days, when i went to tribunal the judge said to answer the questions using what it is like on a bad day and not what it was on the day they know everyone has good/bad days as i said to them yes i do have good days but then you tend to overdo things and suffer for it
i have had RA for 9 yrs and this was my first claim as i didn't know you could claim until i was told by a friend

When applying you need to make sure you stress how much the condition varies on a day to day basis. Just because you can walk 150 metres or whatever does not mean it is very painful to do so. Complete your form as if its the worse day for your condition. Always appeal as this works, they took my DLA car from me and stopped my benefit. Following an appeal, I got my benefit reinstated indefinately and finally got a new motability car. The forms are designed for someone with a stable disability, arthritis changes and you need to stress this point x

I am wonderin if it s even worth bothering to fill the form in . Work past time in school but have severe arthritis in both knees had to have a lot of time off work now am unable to do my job . . Being rent to oc health next week . No chance of keepin my job . . Dont know where to go for advice . Any help gratefully recieved . Regards jan

A note to everyone over a certain age! My mother got help to fill in her DLA forms (she had OA in knees and shoulder) from Help The Aged. She was awarded high mobility and middle care. CAB are good but can be very busy so if you have HTA nearby, try them. No good for the younger ones though!

note to all,the DWP are now at this present time in comsultation in a veiw to renaming the DLA and cutting costs my 20%(380,000 poss taken off DLA)by feb 2011,all those claiming may have to be medically reassed,i am being reassed now having had DLA for 20 years it is a stressfull time as you can imagine.
l realy hope this government sticks by its word by protecting the disabled,l am not so sure though.
if you visit DISABILITY ALLIENCE website it will give you all the info on this l also suggest you save the site to your favorites.

add on to my previous note.
the new DLA is to have only 2 componants to the care allowance and not the present 3.how this will work l realy do not know? but l would suspect it is part of the 20% cut.they are also reveiwing the mobility componant.disabled lawers state this could affect our human rights.

thanks for your help everyone
i went to CAB today and they said i need to make a new claim as my problems and disabilities have changed in the last 2 months.

i will go CAB again for them to help with filling out this form so wish me luck.

to jan smith i had my oc health meeting and i've been off work since june 2010.
my doc was lovely and said that disablility legislation must apply and they have to keep your job availible of an amount of time that seams fire for you to respond to treatment.

saying that my employer as asked me to take voluntarily dismissal due to cabability issues.

i got the meeting 2morrow so we will see as i'm not prepared to do so.

hi thanks jan

it was ok they wanted me to resign which i refused due to my assessment for esa is soon and i didn't want them thinking i am not wanting to go back to work when/if i get better.
so after arguing for a while they asked for another report this time from my g.p which i aggreed and they said if that come back as 3-6 months return to work if the meds start working
they will give me notice with 2 weeks pay.

it just feels they are not helping me just tried to trick me into leaving.i know they have to look after the business and i appreciate that but i got to do what's best for me.
oh well we will see what happens

hi ive just failed my atos medical i have a twised hip, fallen arches in feet, multi joint arthritis including fingers, thyroid trouble, sometimes i cant shop at supermarket as i limp with pain so hubby does most shopping i also have inconinence with bowel 2 a week as i had a big prolapse and have just had 4hr surgery in sept 2011 and i now maybe have prolapse return have to see what they say at hosp the whole atos system is a disgrace i am a 54 yr old woman

hi so sorry to hear this these people seem to be so tight when people need support. I work as a carer and was diagnosed with fibromyalgia in july last year then was also diagnosed with early inflammatory arthritis im 23 and am suffering from a very nasty fibromyalgia flare up which is very painful especially hands wrists and fingers im trying to see if i can get help to get a flat as i have to travel quite far dont know where to begin though

Reading all these comments has made me nervous!I currently have a motability car and lower rate care as I have ra, Im due to have it reviewed in August this year and am getting worried about it already. My condition hasnt improved in fact got worse but it still makes me nervous! I get eesa but have to have a medical once a year, why the government cant just get one agency to do one medical to cover all benfits is beyond me as its so complicated!
I was told by the tax credit people that they are going to abolish eesa and there will just be one universal benefit covering eesa and jsa, not been told this by anyone else though so not sure what is going on.
I hope evrryone is getting on okay with their appeals, dont give up as I know what its like living with this horrible condition and everyone who suffers deserves some help.

Hi davina,
Appeal appeal appeal. I went through a tribunal and they were really supportive and understandning. There is the benefits and work forum that is really helpful and their guides are brilliant. Susan don't give up, appeal too, make sure they pay you the assessment rate on the GL24 FORM and that you write that on the top of the form, you only have a month to appeal. Also check out the appeals guide on the benefits and work forum , you will have to become a member and it costs £19 a year, but you can ask any questions as CAB and benefits advisors are snowed under it is worth it. To all who are appealing and worried about all this, hand in there and thinking of you xx
