Subject: After the Operation

Hi, I am a Young 40yr old who has just had a Sub talor Fusion on my left ankle, I am now in plaster for 3 months! Told employer at interview stage of problems,they appeared to be fine(i am a Support Worker for Learning Dis)have also kept them informed at every stage so, althou in plaster and on crutches, i am well and wanting to return to Light duties,(dr says ok as well)i understand totally that i am not fit to do Normal job,but i am fit to do something!!!
They are not allowing me to return, health and safety reasons! Is there anyone who has experienced the same problems or is there anyone who can give me guidence..My employer provides support for adults with Learning disabilities and Challenging behaviour, No reasonable adjustments have been made to my work place bearing in mind there are two registered disabled employees(myself and one other)So, here ia am able to return to work, recieving SSP and not entitled to any other benenfits...I would be very happy with any info advise as to where i stand in returning to work, i was thinking that as long as my Doctor said i was fit to return on light duties then they had to make reasonable adjustments...Than you in advance for all your help.

I used to work for Sure Start when I had my 2nd hip replacement and they were really understanding too. It was driving me insane being at home all of the time so they agreed to me calling in to the office unofficially for one day a week (my boss would even drive the 20 mile round trip to come and pick me up). I was signed off and being paid sick pay so was unable to return to work (I think it is actually illegal to have someone working who is signed off, particularly as the insurance doesn't cover you). If anyone were to ask I was just popping in to say hi so was covered under the service user insurance! My employers were so grateful for the extra help that they were happy to bend the rules. I don't know how strict they are where you work but it could be worth asking if they'd do the same.

sorry, forgot to say, your doctor can actually "Sign you on" for work again and, in that case your employer must take you back! If they don't they are in breach of the disability discrimnation act!

They are saying that i am unable to preform my duties they employed me for so, hence why they are refusing me to return, have the note from the Doctor.... Have just recieved a call from the house i work at, as i have been continuing to keep in touch with my tenants,(they have visited me at hospital and were due to meet me at home today) have just been told they are not allow to visit me at home with another Support Worker...So now either have to meet at another location or not allowed to see them, This has suddenly come about since i spoke to my manager on Friday to be told i wasn't allowed to return to work, so i told him i would be seeking advice...hhmmm me thinks they are going to be Pains from now on.
Well, i have to say 2 can play that game.
It annoys me so much, have been working for this company for 12 months, Yes have had sick days, but haven't we all, have gone the extra mile for my tenants and have done work above the call of duty, but now i am being treated like this....aaaahhhhhgggg so Mad now...SORRY EVERYONE.

Thank you Lou, my employers are not as nice as yours, I spoke to my office manager at our local head office, "off the record" the other week, and she said, they have to find me employment if the doctor had signed me "fit to work" So watch this Space, i am going to go for the kill now..!!!lol

Hi Tara, there is another arthritis forum 'Arthritis CAre' where there is a section specifically for work related arthritis problems. You might find some good support and advice on there too.

Thank you P, Have been Arthritis Care Forum and got some great help as i have done here, Just joined Unison and wrote huge letter which willno dout do someones head in on Monday morning...lol So heres hoping that someone can give me some sound legalinformationi can go to HR with!!!
